Warsteiner World shall be free to accept a booking request in writing, verbally, in text form (email or fax) or conclusively (by providing the service).
3. Booking Changes or Cancellations by Visitors
3.1. Visitors may change their booking free of charge up to 14 days before the binding, confirmed tour date.
4. Cancellation or Withdrawal by Warsteiner World
4.1. Warsteiner World reserves the right to cancel a confirmed booking for good reason. It shall have a particularly good reason for doing so in the event of technical faults, weather-related disruptions, force majeure or other circumstances for which Warsteiner World or the companies in the Warsteiner Group are not responsible and which make it impossible to perform the contract.
4.2. In addition, Warsteiner World shall be entitled to withdraw from the contract for objectively justifiable reasons, particularly if visitors provide incorrect information or conceal essential facts when booking a tour, or if Warsteiner World has reasonable grounds to believe that the tour may jeopardise the smooth running of the business or the health and safety of visitors and/or the employees of Warsteiner World, the Warsteiner brewery or companies in the Warsteiner Group or the assigned health and safety personnel.
4.3. If Warsteiner World cancels a booking or withdraws from the contract, the visitors concerned shall be reimbursed for any payments they may have made. However, the visitors concerned shall not hold any claims for damages.
5. Prices
5.1. The applicable prices shall be those indicated in the current price list.
5.2. Payment shall be made on site – either in cash or by credit / debit card. An invoice may only be issued by prior arrangement in exceptional cases.
6. Participation in the Brewery Tour
6.1. The brewery tour shall begin at the Warsteiner World Visitor Centre (Zu Hause im Waldpark, D‑59581 Warstein).
6.2. The Warsteiner World Visitor Centre is freely accessible during opening hours. Every visitor who has booked a tour must ensure that their admission ticket (coloured wristband) is clearly visible during the visit to the site; they must present it to the employees of Warsteiner World (hereinafter referred to as “authorised persons”) and hand it over for inspection if necessary.
6.3. The authorised persons may examine visitors who wish to enter the Visitor Centre to determine whether they may pose a health and safety risk due to their specific circumstances, due to any dangerous objects they may be carrying or for other reasons; any such persons may be refused entry. Any visitors who do not consent to such inspections shall be refused entry.
6.4. Visitors must not be accompanied by animals on the brewery tour.
6.5. Visitors are generally prohibited from taking food and drink with them on the brewery tour. In exceptional cases (e.g. if this is necessary due to illness), this must be reported before the start of the brewery tour. Similarly, this does not apply to feeding babies and toddlers.
7. Conduct
7.1. Every visitor and participant in the brewery tour must behave in such a way that no other person is harmed, endangered or bothered. Smoking is only permitted in the outdoor area.
7.2. If an emergency arises at any point during the brewery tour, visitors may press one of the emergency buttons and the service staff shall then provide immediate assistance. For health and safety reasons, visitors are not permitted to stand up and/or leave the premises without being accompanied by the service staff during screenings in the visitors’ cinema or during journeys on the visitors’ train. The service staff shall provide immediate assistance in an emergency.
7.3. Warsteiner World shall be entitled to have its house rules enforced by the authorised persons.
8. Protection of Minors
8.1. The provision and consumption of alcoholic beverages shall be based on the legal provisions, particularly the German Act for the Protection of Minors (JuSchG).
8.2. Those under the age of 16 may only participate in a brewery tour when accompanied by their legal guardian(s); those under the age of 16 shall not be permitted to sample alcoholic beverages.
9. Liability
9.1. Warsteiner World shall be liable according to the statutory provisions if a visitor asserts claims for damages based on intent or gross negligence, including intent or gross negligence on the part of the representatives or vicarious agents of Warsteiner World. If Warsteiner World is not accused of intentionally breaching the contract, its liability for damages shall be limited to the typically foreseeable degree of damage.
9.2. Warsteiner World shall be liable according to the statutory provisions if Warsteiner World culpably violates an essential contractual duty (an obligation which must be observed to enable the proper performance of the contract in the first place and on the observance of which visitors may regularly depend); in such cases, the liability assumed by Warsteiner World shall be limited to the typically foreseeable degree of damage.
9.3. In the case of liability for culpable injury to life, limb or health, the statutory provisions shall remain unaffected; the same applies to cases of mandatory liability under the German Product Liability Act (ProdHaftG).
Warsteiner World shall assume no liability for damages beyond the provisions of 9.1 to 9.3 above, regardless of the legal nature of the asserted claim.
9.4. Insofar as Warsteiner World’s liability for damages is excluded or limited, this shall also apply to Warsteiner Brauerei Haus Cramer KG and to the personal liability for damages assumed by the employees, representatives and vicarious agents of Warsteiner World and Warsteiner Brauerei Haus Cramer KG.
10. Data Protection
Warsteiner World shall store the visitor data required to carry out the brewery tour. Visitors shall consent to the processing of the data required to perform the transaction.
The provisions of data protection law shall apply, as detailed in our privacy policy.
11. Applicable Law
11.1. All contracts concluded by Warsteiner World on the basis of these general terms and conditions – and any resulting claims – shall be subject exclusively to the laws of the Federal Republic of Germany.
11.2. The place of performance and payment shall be the registered office of Warsteiner World.
11.3. If permissible, Warstein shall be the sole place of jurisdiction.
11.4. If individual provisions in these general terms and conditions prove to be ineffective, this shall have no bearing on the effectiveness of the remaining provisions. The ineffective provision shall be replaced by a clause that corresponds or at least comes close to the purpose of the agreement, which would have been established by the parties to achieve the same economic result if they had been aware of the ineffectiveness of the original provision. The same applies to any loopholes found in the agreement.
