General Terms and Conditions

1. Scope of Application

1.1. Warsteiner Welt GmbH & Co. KG, Dom­ring 4 – 10, D‑59581 War­stein (her­ein­af­ter refer­red to as “Warsteiner World”) offers gui­ded tours of the Warsteiner bre­wery in War­stein, fol­lo­wed by tasting sessions.

1.2. Visi­tors shall ack­now­ledge the fol­lo­wing terms and con­di­ti­ons when booking.

1.3. For legal reasons, Warsteiner World shall not accept boo­kings from minors or any other per­sons who do not have full legal capa­ci­ty. Some­thing else shall only app­ly with the neces­sa­ry con­sent of the legal repre­sen­ta­ti­ve. In order to veri­fy such infor­ma­ti­on, visi­tors may be asked to pre­sent an ID card or the con­sent of their legal representative.

2. Booking

A boo­king request to par­ti­ci­pa­te in a bre­wery tour may gene­ral­ly be made ver­bal­ly or in wri­ting. The boo­king reser­va­ti­on shall beco­me bin­ding once the boo­king has been accept­ed by Warsteiner World.

A boo­king may also be made via www.warsteiner-brauerei.de/brauereibesichtigung.

Warsteiner World shall be free to accept a boo­king request in wri­ting, ver­bal­ly, in text form (email or fax) or con­clu­si­ve­ly (by pro­vi­ding the service).

3. Booking Changes or Cancellations by Visitors

3.1. Visi­tors may chan­ge their boo­king free of char­ge up to 14 days befo­re the bin­ding, con­firm­ed tour date.

4. Cancellation or Withdrawal by Warsteiner World

4.1. Warsteiner World reser­ves the right to can­cel a con­firm­ed boo­king for good reason. It shall have a par­ti­cu­lar­ly good reason for doing so in the event of tech­ni­cal faults, wea­ther-rela­ted dis­rup­ti­ons, force majeu­re or other cir­cum­s­tances for which Warsteiner World or the com­pa­nies in the Warsteiner Group are not respon­si­ble and which make it impos­si­ble to per­form the contract.

4.2. In addi­ti­on, Warsteiner World shall be entit­led to with­draw from the con­tract for objec­tively jus­ti­fia­ble reasons, par­ti­cu­lar­ly if visi­tors pro­vi­de incor­rect infor­ma­ti­on or con­ce­al essen­ti­al facts when boo­king a tour, or if Warsteiner World has reasonable grounds to belie­ve that the tour may jeo­par­di­se the smooth run­ning of the busi­ness or the health and safe­ty of visi­tors and/or the employees of Warsteiner World, the Warsteiner bre­wery or com­pa­nies in the Warsteiner Group or the assi­gned health and safe­ty personnel.

4.3. If Warsteiner World can­cels a boo­king or with­draws from the con­tract, the visi­tors con­cer­ned shall be reim­bur­sed for any pay­ments they may have made. Howe­ver, the visi­tors con­cer­ned shall not hold any claims for damages.

5. Prices

5.1. The appli­ca­ble pri­ces shall be tho­se indi­ca­ted in the cur­rent pri­ce list.

5.2. Pay­ment shall be made on site – eit­her in cash or by cre­dit / debit card. An invoice may only be issued by pri­or arran­ge­ment in excep­tio­nal cases.

6. Participation in the Brewery Tour

6.1. The bre­wery tour shall begin at the Warsteiner World Visi­tor Cent­re (Zu Hau­se im Wald­park, D‑59581 Warstein).

6.2. The Warsteiner World Visi­tor Cent­re is free­ly acces­si­ble during ope­ning hours. Every visi­tor who has boo­ked a tour must ensu­re that their admis­si­on ticket (colou­red wrist­band) is cle­ar­ly visi­ble during the visit to the site; they must pre­sent it to the employees of Warsteiner World (her­ein­af­ter refer­red to as “aut­ho­ri­sed per­sons”) and hand it over for inspec­tion if necessary.

6.3. The aut­ho­ri­sed per­sons may exami­ne visi­tors who wish to enter the Visi­tor Cent­re to deter­mi­ne whe­ther they may pose a health and safe­ty risk due to their spe­ci­fic cir­cum­s­tances, due to any dan­ge­rous objects they may be car­ry­ing or for other reasons; any such per­sons may be refu­sed ent­ry. Any visi­tors who do not con­sent to such inspec­tions shall be refu­sed entry.

6.4. Visi­tors must not be accom­pa­nied by ani­mals on the bre­wery tour.

6.5. Visi­tors are gene­ral­ly pro­hi­bi­ted from taking food and drink with them on the bre­wery tour. In excep­tio­nal cases (e.g. if this is neces­sa­ry due to ill­ness), this must be repor­ted befo­re the start of the bre­wery tour. Simi­lar­ly, this does not app­ly to fee­ding babies and toddlers.

7. Conduct

7.1. Every visi­tor and par­ti­ci­pant in the bre­wery tour must behave in such a way that no other per­son is har­med, end­an­ge­red or bothe­red. Smo­king is only per­mit­ted in the out­door area.

7.2. If an emer­gen­cy ari­ses at any point during the bre­wery tour, visi­tors may press one of the emer­gen­cy but­tons and the ser­vice staff shall then pro­vi­de imme­dia­te assis­tance. For health and safe­ty reasons, visi­tors are not per­mit­ted to stand up and/or lea­ve the pre­mi­ses wit­hout being accom­pa­nied by the ser­vice staff during scree­nings in the visi­tors’ cine­ma or during jour­neys on the visi­tors’ train. The ser­vice staff shall pro­vi­de imme­dia­te assis­tance in an emergency.

7.3. Warsteiner World shall be entit­led to have its house rules enforced by the aut­ho­ri­sed persons.

8. Protection of Minors

8.1. The pro­vi­si­on and con­sump­ti­on of alco­ho­lic bever­a­ges shall be based on the legal pro­vi­si­ons, par­ti­cu­lar­ly the Ger­man Act for the Pro­tec­tion of Minors (JuSchG).

8.2. Tho­se under the age of 16 may only par­ti­ci­pa­te in a bre­wery tour when accom­pa­nied by their legal guardian(s); tho­se under the age of 16 shall not be per­mit­ted to sam­ple alco­ho­lic beverages.

9. Liability

9.1. Warsteiner World shall be lia­ble accor­ding to the sta­tu­to­ry pro­vi­si­ons if a visi­tor asserts claims for dama­ges based on intent or gross negli­gence, inclu­ding intent or gross negli­gence on the part of the repre­sen­ta­ti­ves or vica­rious agents of Warsteiner World. If Warsteiner World is not accu­sed of inten­tio­nal­ly brea­ching the con­tract, its lia­bi­li­ty for dama­ges shall be limi­t­ed to the typi­cal­ly fore­seeable degree of damage.

9.2. Warsteiner World shall be lia­ble accor­ding to the sta­tu­to­ry pro­vi­si­ons if Warsteiner World cul­pa­b­ly vio­la­tes an essen­ti­al con­trac­tu­al duty (an obli­ga­ti­on which must be obser­ved to enable the pro­per per­for­mance of the con­tract in the first place and on the obser­van­ce of which visi­tors may regu­lar­ly depend); in such cases, the lia­bi­li­ty assu­med by Warsteiner World shall be limi­t­ed to the typi­cal­ly fore­seeable degree of damage.

9.3. In the case of lia­bi­li­ty for cul­pa­ble inju­ry to life, limb or health, the sta­tu­to­ry pro­vi­si­ons shall remain unaf­fec­ted; the same appli­es to cases of man­da­to­ry lia­bi­li­ty under the Ger­man Pro­duct Lia­bi­li­ty Act (Prod­HaftG).

Warsteiner World shall assu­me no lia­bi­li­ty for dama­ges bey­ond the pro­vi­si­ons of 9.1 to 9.3 abo­ve, regard­less of the legal natu­re of the asser­ted claim.

9.4. Inso­far as Warsteiner World’s lia­bi­li­ty for dama­ges is excluded or limi­t­ed, this shall also app­ly to Warsteiner Braue­rei Haus Cra­mer KG and to the per­so­nal lia­bi­li­ty for dama­ges assu­med by the employees, repre­sen­ta­ti­ves and vica­rious agents of Warsteiner World and Warsteiner Braue­rei Haus Cra­mer KG.

10. Data Protection

Warsteiner World shall store the visi­tor data requi­red to car­ry out the bre­wery tour. Visi­tors shall con­sent to the pro­ces­sing of the data requi­red to per­form the transaction.

The pro­vi­si­ons of data pro­tec­tion law shall app­ly, as detail­ed in our pri­va­cy policy.

11. Applicable Law

11.1. All con­tracts con­cluded by Warsteiner World on the basis of the­se gene­ral terms and con­di­ti­ons – and any resul­ting claims – shall be sub­ject exclu­si­ve­ly to the laws of the Fede­ral Repu­blic of Germany.

11.2. The place of per­for­mance and pay­ment shall be the regis­tered office of Warsteiner World.

11.3. If per­mis­si­ble, War­stein shall be the sole place of jurisdiction.

11.4. If indi­vi­du­al pro­vi­si­ons in the­se gene­ral terms and con­di­ti­ons pro­ve to be inef­fec­ti­ve, this shall have no bea­ring on the effec­ti­ve­ness of the remai­ning pro­vi­si­ons. The inef­fec­ti­ve pro­vi­si­on shall be repla­ced by a clau­se that cor­re­sponds or at least comes clo­se to the pur­po­se of the agree­ment, which would have been estab­lished by the par­ties to achie­ve the same eco­no­mic result if they had been awa­re of the inef­fec­ti­ve­ness of the ori­gi­nal pro­vi­si­on. The same appli­es to any loopho­les found in the agreement.

Cancellation Policy

Visi­tors are gene­ral­ly not entit­led to return their admis­si­on tickets. In the case of lei­su­re ser­vices with a fixed date or peri­od of per­for­mance, visi­tors have no right of can­cel­la­ti­on or return. Each boo­king shall beco­me bin­ding and sub­ject to pay­ment when the con­tract is concluded.
