If Warsteiner World is not accused of intentionally breaching the contract, its liability for damages shall be limited to the typically foreseeable degree of damage.

9.2. 9.3. In the case of liability for culpable injury to life, limb or health, the statutory provisions shall remain unaffected; the same applies to cases of mandatory liability under the German Product Liability Act (ProdHaftG).

The ineffective provision shall be replaced by a clause that corresponds or at least comes close to the purpose of the agreement, which would have been established by the parties to achieve the same economic result if they had been aware of the ineffectiveness of the original provision. The same applies to any loopholes found in the agreement.
